Terms of Service & Refund Policy
Welcome to Kashaya Tantra. Please read these Terms of Service carefully before booking or purchasing any sessions, courses, or products. By making a booking or purchase, you agree to these terms.

 

1. Commitment to the Work 

This work is deep, intimate, and transformational. It requires presence, vulnerability, and a willingness to engage with the process as it unfolds. By booking a session or course, you are committing to your own journey of inquiry and integration.

Sessions and programs may bring moments of discomfort or resistance. These experiences are a natural part of transformational work. You are always welcome to pause within a session to rest, breathe, or regulate.

If you choose to pause the process for an extended period or decide to return at a later time, the work will need to be restarted from the beginning. This means beginning a new container and repurchasing the full session series, including any sessions already used.

This ensures the integrity, continuity, and effectiveness of the work for both client and practitioner.

2. Reciprocity, and Practitioner Discretion​

My work requires a significant investment of time, presence, and energetic focus. For this work to be effective and sustainable, it requires reciprocal commitment from the client.

By entering into sessions or programs with me, you agree to:

• engage sincerely with the practices and guidance offered

• take responsibility for your own participation and integration

• abstain from recreational drugs and alcohol for the duration of our work together, unless otherwise disclosed and agreed upon in advance

Failure to uphold these commitments may compromise the integrity of the work and place undue strain on myself as the practitioner.

I reserve the right, at my sole discretion, to suspend or discontinue sessions if I determine that the process is not being respected or that the conditions required for effective work are no longer present. In such cases, no refunds will be issued.

By booking a session or program, you acknowledge and agree to these terms and to engage with the work in good faith.

3. Boundaries and Consent

All practices are guided by mutual consent and respect. Boundaries will always be discussed and agreed upon in advance. You retain sovereignty over your body and choices at all times.

You may pause within a session if something feels overwhelming, and this will be honoured. However, once a booking is confirmed, the time slot is reserved exclusively for you. Pausing does not extend to postponing or rescheduling.

4. Confidentiality

All sessions are private and confidential. Information shared will not be disclosed unless required by law.

5. Scope of Practice and Responsibility

This work is intuitive, somatic, and relational in nature. It is guided within a clearly held container and focuses primarily on embodied awareness, sensation, and lived experience. As part of the process, I may share reflections, observations, or perspectives to support insight and integration.

This work invites surrender to a guided process and a willingness to explore vulnerability and embodied experience. While I lead and hold the container, you remain sovereign within it and responsible for your own choices, boundaries, and integration outside of sessions.

This work does not constitute medical or psychological treatment and does not replace professional mental health or medical care. I do not diagnose conditions or prescribe medication. You remain responsible for your own wellbeing and are encouraged to seek additional support where appropriate.

6. Suitability and Informed Participation

By booking, you confirm that you are emotionally and physically able to participate in this work, will disclose relevant health or psychiatric information, and will not attend sessions under the influence of substances, including recreational substances. If acute instability emerges, sessions may be paused or referred to other support. No outcomes are guaranteed.

7. Refund & Cancellation Policy

1:1 Sessions

Payments for 1:1 sessions secure your booking and are non-refundable. Once a session is booked, the time is reserved exclusively for you and cannot be reallocated at short notice.

You are welcome to pause within a session if something feels overwhelming, and this will always be honoured. If you choose to pause the process for an extended period or decide to return at a later date, the work will need to be restarted from the beginning. This means beginning a new container and repurchasing the full session series, including any sessions already used.

Sessions may be rescheduled in cases of serious illness with reasonable notice. If I must cancel due to illness or unforeseen circumstances, the session will be rescheduled at the earliest available time.

Courses, Programs & Group Containers

A deposit is required to secure your place and support the preparation and holding of the course container.

Cancellations made more than two weeks (14 days) prior to the course start date are eligible for a refund of the deposit.

Cancellations made within two weeks (14 days) of the course start date are non-refundable, as preparation is underway and my capacity and availability have already been committed.

Please book only when you feel clear and ready to commit.

Digital Courses & Online Products

All digital product and course sales are final. Because access is granted immediately upon purchase, refunds are not available. If you experience technical difficulties accessing your purchase, please contact me within 7 days at marcelle@kashayatantra.com.

8. Payment Terms

All payments must be made in advance unless otherwise agreed.

For 1:1 sessions, full payment or a 50% deposit (where applicable) secures your booking, with the remaining balance payable on or before the session date.

For courses and programs, a 50% deposit secures your place, with the remaining balance due by the course start date unless otherwise specified.

Failure to make payment as agreed will result in suspension or termination of services. No sessions or access will be provided until payment is received.

9. Governing Law

All agreements are governed by the laws of South Africa.
